If you are overwhelmed with debt, chances are you are worried about the possibility of losing your home and property but are concerned about the long-term credit problems and other negative effects of filing for bankruptcy.
Deciding whether to file for bankruptcy is an important choice - and not one you should make without all the facts. It's not your only option, but it really might be a good choice for you. Chapter 13 bankruptcy may be able to stop foreclosure and repossessions - and get you out of debt within 5 years.
I have been practicing as an attorney in debtor-creditor law for over 18 years. My background and experience allow me to help people find practical legal solutions to overwhelming debt.
I can help you decide if Chapter 13 bankruptcy is the best option for you. To begin the process of taking control of your debt so you can get back your peace of mind, contact my Miami law office for a consultation.
Hire an Experienced Chapter 13 Bankruptcy Lawyer
Chapter 13 bankruptcy is often referred to as a debt reorganization or "wage earner" plan. The bankruptcy court will look at your income, reasonable living expenses, and total debt and set up on an extended debt repayment plan.
The repayment plan goes for 3-5 years and has a reduced interest rate and no creditor penalties. You may even include old tax bills in the plan and pay them off at a lower interest rate. If your total debt exceeds what you can afford to pay in 5 years, the rest of your debt is eliminated.
Chapter 13 May Stop Foreclosure
Chapter 13 bankruptcy offers the best chance to stop foreclosure, wage garnishment and repossession. If you took out a second mortgage on your home and now find yourself "upside down" because home values have dropped, you may be able to repay or eliminate your second mortgage through Chapter 13.
Chapter 13 is not for everyone, but for many individuals and families it can provide a practical way to pay off their debts and keep their homes while they get back on track. I also help people with Chapter 7 bankruptcy and foreclosure defense outside bankruptcy.
